JOHN WILLIAM FISHBACK III v. STATE OF MARYLAND

The present case arises from a guilty plea and sentence pursuant to a binding plea agreement between John W. Fishback and the State. On October 3, 2001, Fishback entered a guilty plea to charges relating to attempted murder, along with the use of a handgun in the commission of a felony. After the trial judge ensured that the plea agreement was entered into knowingly and voluntarily and described the sentence for each indictment, the court proceeded to sentence Fishback. In doing so, the judge misstated the case numbers pertaining to each indictment. Fishback appeals to this court, alleging that his sentence was illegal.
